Elite Performance Systems™ respects your privacy and is committed to handling personal information responsibly, transparently and securely.

This Privacy Notice explains what information Elite Performance Systems™ collects, why it is collected, how it is used, when it may be shared, how long it may be retained and the rights available to you.

For the purposes of this notice, “EPS”, “we”, “us” and “our” refer to Elite Performance Systems™.

1. Who Is Responsible for Your Information

Elite Performance Systems™ is responsible for determining how personal information submitted directly to EPS is used.

2. Information We May Collect

The information collected depends on how you interact with EPS.

Website and Enquiry Information

When you visit the EPS website or submit an enquiry, we may collect:

- your name;
- email address;
- telephone number, where provided;
- professional role or business information;
- information included in your message or enquiry;
- your objectives, current challenges and requested level of support;
- technical information such as browser type, device information, approximate location, IP address and website activity.

EPS Performance Diagnostic™ Information

When you complete the EPS Performance Diagnostic™, we may collect:

- your name and contact information;
- your responses to the Diagnostic statements;
- your scores across the Six Performance Pillars;
- information concerning structure, nutrition, training, energy, recovery and execution;
- information relating to sleep, stress, fatigue, physical capacity, lifestyle and performance;
- your reported objectives, limitations and areas of performance friction;
- any additional information you choose to provide.

Some Diagnostic responses may reveal information relating to your physical or mental health. This information is treated as sensitive and is only collected and used for the purposes described in this notice.

The EPS Performance Diagnostic™ is a performance self-assessment. It does not provide medical, psychological or clinical diagnosis.

Consultation, Application and Client Information

When you request a consultation, apply for an EPS engagement or become an EPS client, we may collect:

- consultation and appointment information;
- performance objectives and background information;
- relevant lifestyle, training, recovery and nutritional information;
- communications between you and EPS;
- notes, assessments, recommendations and implementation records;
- progress, adherence and review information;
- documents or information you voluntarily provide;
- information required to deliver and administer the agreed EPS service.

Payment Information

Payments may be processed through Stripe or another authorised payment provider.

EPS does not ordinarily receive or store your complete payment-card details. Payment providers may provide EPS with information such as:

- your name;
- billing contact details;
- transaction amount;
- payment status;
- transaction date;
- invoice or payment reference;
- limited payment-method information.

Payment providers process payment information under their own privacy notices and security arrangements.

3. How We Collect Information

We may collect personal information:

- directly from you;
- through the EPS website;
- through Tally forms;
- through the EPS Performance Diagnostic™;
- through enquiry, application and consultation forms;
- through email or other direct communications;
- during EPS consultations, reviews and client engagements;
- through appointment-scheduling and payment systems;
- automatically through cookies and similar website technologies;
- from a person authorised by you to provide information on your behalf.

4. Why We Use Personal Information

We may use personal information to:

- provide and administer the EPS Performance Diagnostic™;
- calculate and present your Diagnostic results;
- identify reported performance friction across the Six Performance Pillars;
- respond to enquiries;
- assess suitability, readiness and fit for an EPS engagement;
- arrange and conduct consultations;
- interpret Diagnostic results during an EPS Performance Strategy Review™;
- develop and deliver agreed EPS services;
- communicate recommendations, actions and next steps;
- manage bookings, payments, records and client communications;
- maintain service quality and operational consistency;
- improve EPS systems, forms and client delivery;
- maintain the security and proper operation of our website and systems;
- comply with legal, accounting, regulatory and professional obligations;
- establish, exercise or defend legal claims;
- send service communications;
- send promotional communications where you have separately agreed to receive them.

EPS will not sell your personal information.

5. Lawful Grounds for Using Information

Depending on the information and the circumstances, EPS may process personal information because:

- it is necessary to take steps you have requested before entering into an agreement;
- it is necessary to provide a service or fulfil an agreement with you;
- you have provided consent;
- you have provided explicit consent for the use of health-related or other sensitive information;
- processing is necessary for legitimate business interests, including responding to enquiries, administering EPS services, maintaining records and protecting our systems;
- processing is necessary to meet a legal obligation;
- processing is necessary to establish, exercise or defend a legal claim.

Where processing relies on consent, you may withdraw that consent by contacting EPS. Withdrawal will not affect processing that was lawful before consent was withdrawn.

Withdrawal of consent to process information necessary for the Diagnostic or an EPS engagement may mean that EPS can no longer provide the relevant assessment or service.

6. Diagnostic Scoring and Automated Processing

The EPS Performance Diagnostic™ uses structured scoring rules to calculate results across the Six Performance Pillars and indicate where reported performance friction may be concentrated.

This scoring:

- is based on the answers you submit;
- does not provide medical, psychological or clinical diagnosis;
- does not establish confirmed causation;
- does not independently prescribe a personalised intervention;
- does not make a decision producing legal or similarly significant effects.

Professional interpretation, where purchased or provided, occurs separately through an EPS review or consultation.

7. When Information May Be Shared

EPS may share information only where reasonably necessary with service providers supporting its operations, including:

- Tally, which hosts EPS forms and Diagnostic submissions;
- Stripe or another authorised payment processor;
- website hosting and technical-service providers;
- appointment-scheduling providers;
- email and communications providers;
- secure file-storage and administrative systems;
- professional advisers such as accountants, insurers or legal advisers;
- contractors supporting EPS, where appropriate confidentiality and data-protection requirements apply;
- government, regulatory, law-enforcement or judicial authorities where disclosure is legally required.

Service providers may process information according to their own privacy notices and contractual responsibilities.

EPS does not permit service providers to use personal information for unrelated purposes merely because they provide a service to EPS.

8. International Data Processing

EPS may use service providers operating or storing information in countries different from the country in which you live.

For example, Tally is based in Belgium and states that form data is stored in Europe. Payment, hosting, communications and administrative providers may process information in other jurisdictions.

Where data-protection law requires additional safeguards for international transfers, EPS will take reasonable steps to ensure appropriate contractual, legal or technical protections are in place.

9. Information Security

EPS takes reasonable administrative, organisational and technical measures to protect personal information against:

- unauthorised access;
- accidental loss;
- misuse;
- alteration;
- inappropriate disclosure;
- destruction.

These measures may include access controls, password protection, encryption provided by service platforms, secure systems, restricted access and appropriate record-management procedures.

No internet-based service or electronic-storage system can be guaranteed to be completely secure.

10. How Long Information Is Retained

EPS retains personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet legal, contractual, accounting, insurance and record-management requirements.

Unless a longer period is reasonably required:

- Diagnostic information that does not result in an EPS engagement may be retained for up to 12 months;
- general enquiry information may be retained for up to 24 months after the last meaningful communication;
- client assessment, consultation and delivery records may be retained for up to seven years after the client relationship ends;
- transaction, invoice and accounting information may be retained for up to seven years or for another period required by applicable law;
- marketing information may be retained until consent is withdrawn or the information is no longer required.

Information may be deleted earlier where it is no longer necessary, subject to any legal or legitimate record-retention requirement.

EPS may retain anonymised or aggregated information that can no longer reasonably identify an individual.

11. Your Privacy Rights

Depending on where you are located and the law that applies, you may have the right to:

- request access to personal information held about you;
- request correction of inaccurate or incomplete information;
- request deletion of your information;
- request restriction of certain processing;
- object to processing based on legitimate interests;
- withdraw consent;
- request a portable copy of certain information;
- object to direct marketing;
- ask how an automated result was produced;
- lodge a complaint with an applicable privacy or data-protection regulator.

These rights are not absolute and may be subject to legal exceptions.

EPS may need to verify your identity before fulfilling a request.

You may also have the right to complain to the Information Commissioner’s Office in the United Kingdom, the Office of the Australian Information Commissioner or another regulator responsible for privacy in your jurisdiction.

12. Marketing Communications

EPS will only send promotional or marketing communications where there is an appropriate legal basis.

Where consent is required, marketing consent will be requested separately from consent needed to complete the Diagnostic or receive an EPS service.

You may unsubscribe or withdraw marketing consent at any time by:

- using the unsubscribe option included in the communication; or
- contacting nataleeuvrard@eliteperformance.systems.

Withdrawing marketing consent will not affect necessary service or administrative communications.

13. Cookies and Website Technologies

The EPS website and its service providers may use cookies or similar technologies for:

- essential website functionality;
- security;
- remembering user preferences;
- understanding website performance;
- measuring website use;
- supporting embedded or third-party services.

Where consent is legally required, non-essential cookies should not be activated until the visitor has provided consent.

Browser settings may also allow visitors to block or delete cookies. Restricting essential cookies may affect website functionality.

14. Third-Party Websites and Services

The EPS website may contain links to external platforms, including Tally and Stripe.

Once you leave the EPS website or use an external service, that provider may collect and process information under its own privacy notice.

EPS is not responsible for the content, security or independent privacy practices of third-party websites, although EPS takes reasonable care when selecting operational service providers.

15. Information About Other People

Do not provide personal information about another person unless:

- you have their authority to do so;
- the information is relevant and reasonably necessary; and
- you are permitted to provide it.

Where appropriate, you should ensure the other person has been informed about this Privacy Notice.

16. Children’s Information

The EPS Performance Diagnostic™ and EPS engagement pathways are intended for adults aged 18 years and over.

EPS does not knowingly collect personal information from children through the Diagnostic.

If EPS becomes aware that information concerning a child has been submitted without appropriate authority, reasonable steps will be taken to delete or appropriately manage that information.

17. Changes to This Privacy Notice

EPS may update this Privacy Notice when its services, systems, service providers or legal responsibilities change.

The current version will be published on the EPS website with its effective or revision date.

Material changes may also be communicated directly where appropriate.
